https://so07.tci-thaijo.org/index.php/rtnb/article/view/9411

This article aims to propose guidelines for the management of temples and monastic properties in Thai society amidst the challenges of the 21st century, characterized by shifts in legal structures and digital technology. The study reveals that while temples function as legal entities and spiritual centers, they currently face bureaucratic constraints and state control under the Sangha Act B.E. 2505 (1962). Key challenges identified include an aging monastic population, complex administrative burdens, and a lack of digital literacy among ecclesiastical officials (Phra Sangkhathikan), all of which impact transparency and efficiency in asset management.

A critical development strategy is the transition towards Digital Transformation through the “SMART Temple 4.0” model. By integrating the Plan-Do-Check-Act (PDCA) cycle and risk management principles, this model aims to establish a verifiable “Ecosystem of Faith.” It comprises three primary measures: 1) Developing a “Digital Temple Hub” to link monastic property databases and e-Donation systems directly with the Revenue Department; 2) Enhancing digital literacy among monks; and 3) Implementing a Unified Monastic Accounting system on the cloud. These mechanisms align with the Sustainable Development Goals (SDGs), specifically in fostering good governance (SDG 16) and promoting lifelong learning (SDG 4). Ultimately, these advancements will alleviate administrative burdens for the clergy, ensure legal compliance in temple management, and bolster public confidence in the transparent administration of monastic properties in the digital era.
PhramahaNattapon Issaradhammo PhramahaAdisak Piyaseelo Attachai Sudbonid

https://so07.tci-thaijo.org/index.php/rtnb/article/view/9746

This article aims to explain and examine the relationship between Buddhist doctrines and contemporary democratic thought within the context of Thai society, particularly in the political, cultural, and public ethical dimensions. The study employs documentary research combined with interpretative analysis in order to systematically connect key Buddhist principles with democratic governance. The findings suggest that the principle of Dhammādhipateyya (the supremacy of Dhamma) can function as a normative ethical framework for democracy by emphasizing the exercise of power based on reason, moral correctness, and accountability. The three forms of sovereignty Attādhipateyya (self-centered authority), Lokādhipateyya (socially driven authority), and Dhammādhipateyya reflect a progressive development of power from the individual and social levels toward the primacy of moral principles. In addition, the Yebhuyyasikā procedure, which resolves disputes through majority decision-making within the Buddhist monastic community, demonstrates a form of democratic practice that integrates majority rule with ethical restraint. This approach differs from purely quantitative democracy, which focuses solely on numerical majority. Therefore, Buddhism is not only compatible with democratic principles but also contributes an essential ethical dimension to Thai politics. The concept of “Buddhist Democracy” broadens the study of democracy from a purely structural perspective to a value-oriented framework, offering significant contributions to cultural political theory and supporting the sustainable application of democratic principles in multicultural societies.
PhrakruUdomDhammavutPhramahaSuttidon JittapanyoPhrakruSudhisarabandhitPhamahakitti kittimatee Thawatchai SapsombatThida Chuchot

2025-12-312025-12-3173187201Legal Problems of Precontractual Liability
https://so07.tci-thaijo.org/index.php/rtnb/article/view/9088

The Civil and Commercial Code does not clearly define the meaning, scope, and extent of pre-contractual liability. This raises the question of whether a party who suffered damages during negotiations can claim compensation for the damages incurred, and based on which legal principles, as the damage occurred prior to the contract. The objectives of this qualitative research were to: 1) study the principle of pre-contractual liability that parties are responsible for incurring pre-contractual obligations; 2) compare the principle of pre-contractual liability under the German Civil Code and the principle of pre-contractual liability under the Thai Civil and Commercial Code; and 3) propose guidelines for applying the principle of pre-contractual liability in the Thai legal system. This research primarily relies on documentary research, examining legal texts in both Thai and foreign languages, as well as relevant legal articles. The results reveal that the Thai Civil and Commercial Code does not specifically address pre-contractual liabilities in the Thai legal system. Furthermore, there are no Supreme Court decisions or the opinions of most legal experts expressing clear acceptance of the concept of pre-contractual liability in the Thai legal system, as in German law. However, the Thai legal system may be able to apply the provisions of Section 5 of the Civil and Commercial Code on the principle of good faith, by interpreting the law to include the legal principle of breach of pre-contractual obligations, so that a party who acts dishonestly during the pre-contractual period, causing damage to the other party, is liable for his or her own actions. This will serve as a guideline for the application of the principle of pre-contractual liability in the Thai legal system.
Yuwadee Muntiyakankul
