PRINCIPAL OF OWNERSHIP TRANSFER MOVABLE PROPERTY ACCORDING TO THE SALES CONTRACT

This article will study the legal principles regarding the transfer of ownership of movable property by sales contract in the Thai legal system. This holds the principle that ownership of movable property transfers to the buyer at the time of making the contract. and ownership of the property sold It will be transferred to the buyer from the moment the sales contract is made. Unless an exception is made otherwise. It is not necessary that the transferee or buyer must have the property in their possession in any way. Delivery is only a duty to satisfy the seller‘s debt. It is not related to the results of the transfer of ownership or property rights.
As for the case of special types of movable property, that is, boats with a capacity of five tons or more, rafts, and beasts of burden. In addition, special types of movable property sales contracts according to the Thai legal system, such as the transfer of ownership of ships, airplanes, and motor vehicles, If not registered If not made in writing and registered with the authorized official The said sales contract will be void. It has no legal effect. and ownership will not be transferred to the buyer in any way.
