PROTECTION OF THE RIGHTS OF INTANGIBLE CULTURAL HERITAGE HOLDERS: TOWARDS THE DEVELOPMENT OF A SUI GENERIS LAW IN THAILAND

Abstract

This qualitative research aimed to: 1) to study the problems and limitations of laws and measures concerning the protection of intangible cultural heritage and individuals associated with such heritage in Thailand; 2) to examine the appropriateness of determining the legal status and rights of intangible cultural heritage right holders; and 3) to analyze and propose guidelines for developing legal mechanisms to protect the rights of intangible cultural heritage right holders, covering free, prior and informed consent, as well as fair and equitable benefit-sharing. The target population for this research consisted of 25 individuals, divided into 5 groups of 5 participants each. They were selected using purposive sampling from those possessing knowledge or direct experience with intangible cultural heritage. The research findings revealed that     Thai law lacks clear provisions establishing the legal status and rights of persons associated with intangible cultural heritage. The study therefore proposes the concept of Cultural Unit as a basis for determining status at the international level and the concept of Intangible Cultural Heritage Rights Holder as a basis for recognition at the state level. The study further proposes recognizing the rights of Intangible Cultural Heritage Holders to Free Prior Informed Consent and Fair and Equitable Benefit Sharing. These approaches would contribute to the development of a sui generis legal framework that systematically protects both intangible cultural heritage and its rights holders, while remaining consistent with Thailand’s cultural context and international standards and promoting the sustainable transmission and utilization of intangible cultural heritage
