ปัญหาเกี่ยวกับบทบังคับโทษในพระราชบัญญัติประกันสังคม กรณีนายจ้าง

บทความวิชาการนี้มีวัตถุประสงค์เพื่อศึกษาข้อจำกัดที่เป็นอุปสรรคต่อการบังคับใช้กฎหมายอย่างมีประสิทธิภาพในพระราชบัญญัติประกันสังคม พ.ศ.2533 โดยเฉพาะกรณีบทบังคับโทษสำหรับนายจ้าง อัตราโทษที่กำหนดไว้ในปัจจุบันอยู่ในระดับต่ำเกินไปจนไม่สามารถทำหน้าที่เป็นเครื่องมือยับยั้งการกระทำความผิดในเชิงเศรษฐกิจได้ ทำให้นายจ้างมองว่าค่าปรับเป็นเพียงต้นทุนในการดำเนินธุรกิจที่ยินดีจ่ายเพื่อแลกกับการไม่ต้องปฏิบัติตามหน้าที่ นอกจากนี้ยังพบประเด็นปัญหาจากการที่นายจ้างจงใจยื่นเอกสารแต่ไม่นำส่งเงินจริงเพื่อหลีกเลี่ยงโทษอาญา เนื่องจากกฎหมายไม่มีบทลงโทษทางอาญาโดยตรงกรณีค้างชำระเงินสมทบ ในขณะที่การลงโทษนิติบุคคลยังเผชิญกับข้อจำกัดด้านเพดานโทษปรับและอุปสรรคในการพิสูจน์ความรับผิดของผู้มีอำนาจสั่งการ อีกทั้งการใช้อำนาจดุลพินิจของเจ้าหน้าที่ในการเปรียบเทียบปรับโดยขาดมาตรฐานกลางที่ชัดเจน ยังส่งผลต่อความเชื่อมั่นในระบบยุติธรรมและสร้างความเหลื่อมล้ำในการแข่งขัน ด้วยเหตุนี้ จึงควรพิจารณาปรับปรุงอัตราโทษให้มีความเหมาะสมกับสภาวะเศรษฐกิจ เพิ่มมาตรการทางปกครองที่รุนแรงเพื่อควบคุมพฤติกรรมนายจ้าง และกำหนดหลักเกณฑ์ที่ชัดเจนสำหรับการเปรียบเทียบปรับ เพื่อรักษาความศักดิ์สิทธิ์ของบทบังคับโทษและสร้างความมั่นคงให้แก่กองทุนประกันสังคมอย่างแท้จริง
