The Development Of Legal Measures On The Offense Of Child Abandonment

Abstract

          This research aims to analyze legal issues and obstacles in enforcing legal measures related to child abandonment under the Criminal Code. The study examines Thai law in comparison with international laws and proposes solutions. This study, in conjunction with other relevant Thai laws, examines solutions to the problem posed by the laws of various countries, including Texas, California, the United Kingdom, Germany, and Japan. The objectives are to identify ways to develop legal measures in Thailand to better protect children from abandonment. The research findings indicate that Thailand's current law on child abandonment under the Criminal Code fails to protect children over 9 years of age from abandonment and does not specify the age of the offender. Furthermore, the severity of the offense presumes only the severity of the offense, without any indication of the severity of the offense. Therefore, it is appropriate to amend Section 306 of the Criminal Code by raising the age requirement for children who are victims of child abandonment.
