Legal Issues in the Thai Esports Industry

Abstract

          This research article aims to analyze the labor law situation in the Thai esports industry. It found that existing laws are inclusive and outdated, and there are no specific laws for this profession. Survey and comparative research methods were used to synthesize and compare in-depth data from 203 samples to international practice and propose solutions that are consistent with the Thai social context.

          The research findings indicate that esports industry is among the fastest-growing sectors in the digital era, driven by the expansion of market value, fan base, and investment. However, the Thai esports industry continues to face structural challenges, particularly concerning labor law and worker protection. Key groups such as freelance athletes, content creators, and streamers often lack clear legal protection, making them vulnerable to unfair contracts. A survey of 203 participants revealed that 75% were under the age of 25, 42.9% were female, and most held a bachelor’s degree. The primary issues identified were vague employment contracts, inadequate compensation, and a lack of welfare benefits, which are prevalent problems among the majority of workers with regular income. At the international level, organizations such as the Esports Integrity Commission (ESIC) and FIFA have established player rights standards. However, Thailand still lacks clear policies due to factors such as low awareness among workers, the absence of strong labor representation, and outdated legislation. This article therefore proposes legal reforms, the development of standard contracts, and the adaptation of international standards to foster a fair and sustainable esports industry.
