Abstract

          This academic article aims to study the current Thai legal framework regarding AI and contract drafting advice, comparing the regulatory approach with the EU AI Act framework. This is because AI currently plays a significant role in many areas, including law, where it can improve efficiency and speed. However, AI also creates gaps in legal status and liability. If errors occur in legal advice, the study found that Thai law is insufficient and lacks specific provisions to clearly define the scope of liability. This differs from the European Union, which has specific laws and uses a "risk-based approach" with clear processes. Based on the study, the author agrees that Thailand is about to enact specific legislation on AI regulation using a "risk-based" approach in line with the European Union. The author recommends accelerating this process and classifying AI that provides legal advice, particularly in contract law, as high-risk AI to ensure clear, transparent, and fair liability determination in legal proceedings.
