Abstract

This research aims to analyze the principles, concepts, theories, as well as problems and obstacles to laws related to the state's use of power in preventing and controlling online media, particularly Facebook, in the case of online sexual harassment in Thailand. The research employs a qualitative methodology through document research, examining legal theories, computer-mediated communication theory, the concept of public space, and digital governance, coupled with an analysis of relevant Thai laws, including the Computer Crime Act B.E. 2550 (2007) and its amendments, the Penal Code, and the Civil and Commercial Code. The findings indicate that the state has a duty to protect citizens and the public interest, but the exercise of power must adhere to the principles of the rule of law, human rights, necessity, appropriateness, and proportionality. Furthermore, Thai law has gaps in addressing online sexual harassment on Facebook. The definition and offenses of online sexual harassment do not adequately cover certain digital behaviors, such as the dissemination of sexually explicit images or videos without consent (revenge pornography) and online stalking (cyberstalking). This necessitates the application of multiple laws, which are not always consistent with the characteristics of the digital world, and lacks measures to quickly mitigate damage. Furthermore, there are limitations in enforcing these regulations on cross-border platforms. Therefore, the development of laws and regulatory mechanisms for online media should focus on balancing the protection of citizens with the protection of rights and freedoms, emphasizing proportionality, transparency, checks and balances, and collaborative regulation, rather than centralizing power in the sole concentration of the state
