The objectives of this research paper are 1) to study the 3rd Benjasila Principle in Theravada Buddhism, 2) to study the Civil and Commercial Code, and 3) to analyze the analytical comparison of the 3rd Benjasila Principle with the Civil and Commercial Code. This research is a documentary research. by studying the Tripitaka Buddhist academic papers Civil and Commercial Code and Legal Academic Documents Then present the research results by descriptive analysis method. The results of the study revealed that the third principle of the Benchasila, Kamesumicchara Veramani, is abstinence from all sexual misconduct. which is an unhealthy behavior and it is a social principle of human beings that fosters respect for the rights of those who are loved and cherished by others. Build solidarity with family institutions Create a solidarity and trust each other of people in society As for the Civil and Commercial Code, the duties of the husband and wife under Section 1461, if either spouse commits a breach of duty, causes the other to file a claim for divorce under Section 1516 (1) and may claim compensation under Section 1523 when: An analytical comparison of the Principle No. 3 with the Civil and Commercial Code has revealed that Husband and wife according to the Five Principles, Article 3, has the meaning covering husband and wife according to the Civil and Commercial Code, violations of the Five Principles.
