Abstract

This research aims to Study the level of understanding the Official Tort Liability Act, B.E. 2539 2) To study the guidelines for conducting themselves in the responsibility for Tort  Liability Act 1996 of Pho Thong Subdistrict Municipality, Selaphum District, Roi Et Province. Use mixed method research. population in this research namely, Pho Thong Subdistrict Municipality, Selaphum District, Roi Et Province, 60 people8 experts selected by purposive sampling from agencies with different roles as follows: 2 judges 2) 2 lawyers 3) 2 legal government officials 4) 2 prosecutors person.

The results showed that The population used in this study were 60 municipal officials of Pho Thong Subdistrict, Selaphum District, Roi Et Province. Most of them were males, aged 40-50 years old. Have an average monthly income from 20,000 baht, have a service life of 5 years1) Understanding of the Official Tort Liability Act, B.E. 2539 of Pho Thong Subdistrict Municipality, Selaphum District, Roi Et Province. Overall, it was at a high level.2) Guidelines for the conduct of government officials To receive fair protection from their agencies. At present, a law on tort liability of officials has been enacted. which is the Official Tort Liability Act, B.E. 2539 Which has an important principle that “Damage from the abuse of officials in the performance of their duties Government agencies will bear the burden of paying compensation to those who have been damaged first. As for officials, are they liable to pay compensation to government agencies? How much is based on the principle that the claim can be made to the officer only in the event that the damage is caused by intentional action or gross negligence
