อาชญากรรมการรุกราน: วิเคราะห์องค์ประกอบความผิดและอุปสรรค ต่อการดำเนินคดีในศาลอาญาระหว่างประเทศ

บทคัดย่อ
การวิจัยนี้เป็นการวิจัยเชิงเอกสาร มีวัตถุประสงค์เพื่อศึกษาวิวัฒนาการของอาชญากรรมการรุกรานตามกฎหมายอาญาระหว่างประเทศ วิเคราะห์องค์ประกอบความผิดฐานอาชญากรรมการรุกรานและอุปสรรคต่อการดำเนินคดีในศาลอาญาระหว่างประเทศ หรือ ศาล ICC (International Criminal Court) และ เพื่อศึกษาวิเคราะห์แนวทางในการแก้ไขอุปสรรคต่อการดำเนินคดีความผิดฐานอาชญากรรมการรุกรานในศาล ICC ผลการวิจัยพบว่า
1) องค์ประกอบความผิดฐานอาชญากรรมการรุกรานในบทบัญญัติข้อ 8bis แห่งธรรมนูญกรุงโรมฯ มีลักษณะพิเศษเฉพาะตัวซึ่งมีความแตกต่างจากองค์ประกอบความผิดของอาชญากรรมระหว่างประเทศร้ายแรงฐานอื่นที่อยู่ภายในเขตอำนาจของศาล ICC ทั้งองค์ประกอบภายนอก (actus reus) และองค์ประกอบภายใน (mens rea)
2) อาชญากรรมการรุกรานถือว่าเป็นรูปแบบของการใช้กำลังในความสัมพันธ์ระหว่างประเทศที่ร้ายแรงที่สุดอันเป็นการละเมิดกฎบัตรสหประชาชาติโดยชัดแจ้ง แต่รัฐภาคีแห่งธรรมนูญกรุงโรมฯ เพียง 49 รัฐเท่านั้น (จากจำนวนทั้งสิ้น 125 รัฐ) ที่ได้ยอมรับเขตอำนาจศาล ICC เหนืออาชญากรรมการรุกราน มีผลทำให้เกิดอุปสรรคหลายประการต่อการดำเนินคดีความผิดฐานอาชญากรรมการรุกรานในศาล ICC อย่างมีนัยสำคัญ
3) การแก้ไขอุปสรรคต่อการดำเนินคดีความผิดฐานอาชญากรรมการรุกรานในศาล ICC ให้มีประสิทธิผลมากยิ่งขึ้นนั้น ประชาคมระหว่างประเทศสามารถดำเนินการได้หลายแนวทาง เช่น การยอมรับให้อาชญากรรมการรุกรานมีฐานะเป็นอาชญากรรมสากล การกำหนดให้อาชญากรรมการรุกรานเป็นความผิดตามกฎหมายอาญาภายในของรัฐ และการให้ความร่วมมืออย่างจริงจังในส่วนของอาชญากรรมระหว่างประเทศร้ายแรง
