Abstract

The criminal justice system that has a process of investigating the truth in cases that can be appropriately punished for the person who committed the crime. It is the most effective criminal justice system. Under the rule of law, it is important that criminal investigation work is the primary source for collecting important evidence in cases that confirm the guilt or innocence of the accused or defendant. Which affects the form of the case in the trial and adjudication in the Court of First Instance, the Court of Appeal and the Supreme Court. 1.To study and analyze criminal investigations in accordance with the rule of law in Thailand 2.To study, analyze and compare criminal investigations in accordance with the rule of law in Thailand with the Federal Republic of Germany and the French Republic.


The study found that   under the rule of law or the rule of law The judicial process must thoroughly examine the truth (Examination Principle) in two things, namely the facts of the offence and the facts of the offender, and pass on the "truth" of both of them. to go to trial to the judge for the discretion of the appropriate punishment for the person (Individualization of punishment), with suggestions that to be able to punish appropriately for the individual Investigations must be carried out carefully under the principles of criminal procedural law and the rule of law. In order for the user to judge and judge the investigation, it is necessary to rely on the rule of law as a concept and function as the basis. to obtain judgments based on factual databases obtained by using "Examination Principle" as a process for judging cases into "Justice" in the judgment of the case individually. in order to use "criminal enforcement measures" to be appropriate for the person in the end
