DESIGNATING INVESTIGATIVE INTERVIEWINGING AS THE PRIMARY MEASURE IN THE INTERROGATION OF CHILDREN AND JUVENILES

Abstract
Regarding the issues with interrogating children and juveniles during the investigative phase under the Criminal Procedure Code, there are inappropriate practices that do not respect human rights and violate children's rights. Even though the law stipulates the involvement of multidisciplinary professionals in the interrogation of children and juveniles, this does not guarantee full protection for the children. This article therefore studies concepts and theories related to the interrogation of children and juveniles under Thai and international law. A comparative study was conducted on the legislative approaches of foreign countries, namely England and Wales, Australia, Norway, and New Zealand. The objective is to find appropriate methods for interrogating children and juveniles and protecting their rights in the investigative phase. From this documentary research, it was found that a new form of interrogating children and juveniles, called the Investigative Interviewing method, is an appropriate method for conducting interrogations of children and juveniles, respecting human rights, and not violating children's rights. Furthermore, interviewing using the Investigative Interviewing method will yield complete, accurate, and reliable information from the incident leading to the punishment of the true offenders and building public confidence in the criminal justice process.
This article therefore proposes amendments to Thailand's Criminal Procedure Code to establish a more efficient standard for conducting interrogations with children and juveniles in the investigative phase and to fully protect the rights of children and juveniles by stipulating the types of cases where the investigative interviewing method should be used, the police investigator who performs the interrogation, the recording of audio and video during the interrogation, and the application of the investigative interviewing method in interrogating children and juveniles.
