บทคัดย่อ
การศึกษาเรื่อง “การเสริมสร้างประสิทธิภาพการคุ้มครองผู้ประพันธ์เพลงไทยด้วยกรอบกฎหมายสนธิสัญญาว่าด้วยลิขสิทธิ์ขององค์การทรัพย์สินทางปัญญาโลก (WCT) และนวัตกรรมบล็อกเชน” มีวัตถุประสงค์เพื่อ (1) ศึกษากรอบสนธิสัญญาว่าด้วยลิขสิทธิ์ขององค์การทรัพย์สินทางปัญญาโลก (WIPO Copyright Treaty: WCT) ในการคุ้มครองสิทธิของผู้ประพันธ์เพลงในยุคดิจิทัล (2) วิเคราะห์ข้อจำกัดและข้อยกเว้นของระบบกฎหมายลิขสิทธิ์ไทยในการคุ้มครองสิทธิของผู้ประพันธ์เพลงในบริบทดิจิทัล และ (3) เสนอแนวทางการบูรณาการกรอบกฎหมาย WCT กับนวัตกรรมบล็อกเชนเพื่อเสริมสร้างประสิทธิภาพการคุ้มครองผู้ประพันธ์เพลงไทย งานวิจัยนี้เป็นการวิจัยเชิงเอกสาร (Documentary Research) โดยรวบรวมและวิเคราะห์ข้อมูลจากกฎหมายลิขสิทธิ์ของไทย กฎหมายระหว่างประเทศภายใต้กรอบ WCT เอกสารจากองค์การทรัพย์สินทางปัญญาโลก (WIPO) และงานวิชาการที่เกี่ยวข้อง ด้วยวิธีการวิเคราะห์เปรียบเทียบทางกฎหมาย เพื่อนำไปสังเคราะห์เป็นข้อเสนอเชิงนโยบายในการพัฒนากฎหมายลิขสิทธิ์ไทยให้สอดคล้องกับมาตรฐานสากล
ผลการวิจัยพบว่า (1) สนธิสัญญา WCT มีบทบาทสำคัญในการกำหนดมาตรฐานสากลด้านการคุ้มครองสิทธิแต่เพียงผู้เดียวของผู้ประพันธ์เพลงในสื่อดิจิทัล โดยครอบคลุมสิทธิในการทำซ้ำ การเผยแพร่ และการสื่อสารต่อสาธารณะ รวมถึงการกำหนดมาตรการคุ้มครองทางเทคโนโลยี (Technological Protection Measures: TPMs) และข้อมูลการจัดการสิทธิ (Rights Management Information: RMI) เพื่อป้องกันการละเมิดลิขสิทธิ์ (2) ระบบกฎหมายลิขสิทธิ์ไทยแม้จะมีข้อยกเว้นตามหลักการใช้โดยชอบธรรม (Fair Use) และการใช้เพื่อประโยชน์ทางการศึกษาและสาธารณะ แต่ยังคงมีข้อจำกัดด้านการบังคับใช้และการรับมือกับการละเมิดลิขสิทธิ์ในสื่อออนไลน์อย่างมีประสิทธิภาพ และ (3) การบูรณาการเทคโนโลยีบล็อกเชนสามารถเสริมสร้างกลไกการคุ้มครองลิขสิทธิ์ให้มีความโปร่งใส ตรวจสอบได้ และเพิ่มความน่าเชื่อถือในการจัดเก็บค่าลิขสิทธิ์ อันเป็นการสนับสนุนการบังคับใช้กฎหมายให้สอดคล้องกับหลักสามขั้นตอน (Three-Step Test) ภายใต้กรอบของสนธิสัญญา WCT
