A. COPYRIGHT OWNERSHIP AND GRANT OF RIGHTS
For the purposes of this License, the term “Work” refers to the full content of the article, including but not limited to the abstract, tables, figures, graphs, images, multimedia elements, and any subsequent errata published with the article. “Supplementary Material” refers to content associated with the article that is made available separately in electronic form, such as datasets or additional files.
This Agreement constitutes an Exclusive License to Publish, not a transfer of copyright. The copyright in the Work remains with the Author(s), or, in the case of a Work Made for Hire, with the Author(s)’ employer(s).
The Office of Arts and Culture, Surindra Rajabhat University, Thailand, shall retain the right to register the copyright for the journal issue or any collective work in which the Work is included. The rights granted under this License become effective only upon acceptance of the Work for publication by the Office of Arts and Culture. Should the Work not be accepted, this License shall be rendered null and void.
Each copyright holder hereby grants to the Office of Arts and Culture, Surindra Rajabhat University, Thailand, the following irrevocable rights for the full duration of the copyright:
1. Exclusive Rights to the Work: The exclusive right and license to publish, reproduce, distribute, transmit, display, store, translate, edit, adapt, and create derivative works based on the Work, in whole or in part, worldwide and in all formats and media now known or later developed. The Office is also granted a non-exclusive right to do the same with the Supplementary Material.
2. Sublicensing and Transfer: The right to sublicense or transfer any or all the exclusive rights listed above, including the authority to permit third parties to reuse the Work.
3. Protection and Enforcement: The right to take any action deemed necessary to protect and enforce the granted rights, at its own expense, against any third-party infringement.
B. AUTHOR RIGHTS AND PERMITTED USES
Subject to the rights granted to the Office of Arts and Culture under this License, each copyright holder retains ownership of the copyright and all other proprietary rights in the Work, including but not limited to patent rights.
Authors are permitted to use the Work in a variety of ways without needing additional permission from the Office of Arts and Culture, provided such use aligns with accepted professional publishing ethics and proper attribution is given. Any reuse must clearly credit the original publication in the Arts and Culture Journal of the Lower Moon River, and must include a citation with a link to the journal’s official website.
Authors may exercise the following nonexclusive rights:
1. Reprint Excerpts: Reuse portions of the Work (e.g., figures, tables, or excerpts) in future works authored by the Author, in accordance with publishing ethics.
2. Author Websites: Post the Accepted Manuscript (AM) on the Author’s personal website or their employer’s website immediately following acceptance.
3. Repository Deposit for AM: Deposit the AM in institutional or funder-mandated repositories immediately after acceptance.
4. Scholarly Networks: Share the AM within scientific collaboration networks for scholarly communication.
5. Theses and Dissertations: Include the Version of Record (VOR) in printed collections of the Author’s Work, including theses or dissertations. Electronic availability via university websites or repositories, and print-on-demand sales, are permitted.
6. Course Use: Use and distribute copies of the VOR for teaching purposes at the Author’s institution, provided no fee is charged for access.
7. Internal Training: Use the VOR for internal, noncommercial training or business activities by the Author’s employer.
8. Oral Presentations: Include the VOR in oral presentations (e.g., conferences, seminars), with notice to recipients that further copying or distribution is not permitted.
9. Colleague Sharing: Distribute the VOR to colleagues for personal, noncommercial scholarly use, with the same no-redistribution notice.
10. Website Posting for VOR: Post the VOR on the Author’s personal or institutional website 12 months after official publication.
11. Repository Deposit for VOR: Deposit the VOR in institutional or funder-designated repositories 12 months post-publication.
12. Update Prior Postings: Replace earlier versions of the Work with the VOR on noncommercial platforms 12 months after publication.
C. AUTHOR REPRESENTATIONS AND WARRANTIES
Each Author and Copyright Owner represents and warrants to the Office of Arts and Culture, Surindra Rajabhat University, Thailand, that:
1. Originality and Rights: The Work is an original, independent creation of the Author(s) and does not infringe upon any copyright, trademark, or other proprietary rights of any third party.
2. Prior Publication: The Work has not been previously published and is not under consideration for publication elsewhere in any form, except as a preprint on a noncommercial server or as part of a thesis or dissertation.
3. Permission for Third-Party Material: Written permission has been obtained for all third-party content included in the Work. Copies of these permissions have been submitted to the Office of Arts and Culture as part of the manuscript file.
4. Proper Attribution: All third-party materials for which permission has been secured have been appropriately credited within the manuscript.
5. Institutional Conflicts: If the Author is subject to university open access mandates or other institutional policies that conflict with the terms of this License, the Author has obtained a waiver or other necessary authorization from the institution to enter into this agreement.
D. Execution and Authority
This License must be signed by the Author(s) and, in the case of a Work Made for Hire, also by the applicable Copyright Owner(s). One individual may sign on behalf of all contributors and rights holders only if duly authorized to do so and with the full consent and agreement of all parties involved.
The signing party warrants that they have full legal authority to enter into this License and to grant the rights set forth herein.
E. Electronic Signature and Consent
By signing below, I confirm my agreement to the terms of this Copyright License, including the representations and warranties above. I consent to the execution and delivery of this agreement in electronic form and acknowledge that my electronic signature has the same legal validity as a handwritten signature. I further confirm that I have obtained written authorization from all co-authors or rights holders to execute this agreement on their behalf.
