OVERVIEW OF ALCOHOL BEVERAGE CONTROL LAW IN THAILAND AND OTHER COUNTRIES NOWADAY

Abstract

          Legislatures of different countries has tried to solve problems to reduce the harm of alcohol consumption to have an appropriate level of consumption together with the creation of "awareness" via various types of media, determination of prohibited areas for sale, age, treatment, suppression, civil liabilities, criminal penalties, methods for safety effective law enforcement and also taxation. However, in Thailand, the Alcohol Control Act B.E. 2551, which has been in force for more than 10 years, was found to be ineffective in enforcing. It does not have much effect on controlling alcohol consumption.

          Therefore, the research team has conducted a comparative analysis of law enforcement measures to reduce harm from alcohol consumption in the Federal Republic of Germany, Scotland, the Commonwealth of Australia, Malaysia, Singapore, and Japan to find guidelines that that should be applied to Thailand in order to find legal measures that are best practices that are suitable for producers, consumers, and the stat. on the following issues.

1. Marketing control alcohol advertising especially with younger people To avoid inviting excessive alcohol consumption.


2. Control and Limitation sale of alcohol by registering an entrepreneur In order for all businesses related to the production, import and sale of alcoholic beverages in Thailand to be in the state's control system.


3. Reducing consumption demand through collection of excise taxes, customs and a new pricing mechanism so that production costs are not high and the overall alcoholic beverage business is well managed


4. Integrating the operations of all relevant agencies, both government and private sectors, to be in the same direction.
