LEGAL MEASURES FOR REGULATING ORGANIC FOOD PRODUCTS: A CASE STUDY OF EUROPEAN UNION, UNITED STATES, CANADA, AUSTRALIA AND SWEDEN

Abstract

          This article employs a documentary research methodology with the objective to present regulatory frameworks governing organic produce for the benefit of consumers in making their informed choices. Therefore, it focuses on health and food safety, and examines not only standards across various international contexts (e.g. the European Union, the United States, Canada, Australia, and Sweden) but also the International Federation of Organic Agriculture Movements (IFOAM). This is to pave the way for the introduction of useful strategic guidance to enhance the quality and competitiveness of Thai organic produce in the global market. The key findings can thus be summarized as follows:


          First, regarding "regulatory organizations", it is essential to establish a central authority that acts as an organic agricultural standards verification mechanism for domestic market and export purpose.


          Second, with respect to the "labeling" issue, the national organic label or so-called ‘country-specific trademark’ should be implemented. This system should be primarily administrated by government agencies, while private sector is allowed to participate in the inspection and labeling processes through a certified license.


          Third, in terms of "environmental responsibility", the emphasis should be placed on the adoption of an ecological approach to organic agriculture. Both public and private sectors, therefore, must prioritize their respect for ecological balance.


          In addition, there should be a "consumer protection mechanism" that focuses on the responsibility and accountability of all stakeholders in maintaining the integrity of organic produces. This is to protect the organic sector from criminal activity and dissemination of false information to consumers.


          In conclusion, the regulation of the compliance of Thai organic produce with international standards will both promote the right to food, which eventually leads to food security and be a policy aligning with Sustainable Development Goals (SDGs).
