Effectiveness of Protection of Migrant Workers in Thailand

Abstract

The researcher set the objectives to study the effectiveness of labor protection. Factors Affecting the Labor Protection including study the problems and obstacles of the protection of foreign workers. The research study was conducted by qualitative research. The type of case study and data collecting by interviewing of enterprise had employed migrant workers in the area of the Bangkok by have been selected from the Bangkok Labor Protection and Welfare Office, in 3 locations, consisting of (1) Bangkok Labor Protection and Welfare Office Area 3 (2) Bangkok Labor Protection and Welfare Office Area 4 and (3) Bangkok Labor Protection and Welfare Office Area 5 Findings are as follows: 1. The effectiveness of labor protection in the enterprise of migrant workers employment found that (1) The minimum wage was declared to protect workers in order to migrant workers (6) can receive the wage correctly. (2) Foreign workers must receive welfare from their employers as required by law (3) Foreign workers must be treated equally, fair, without discrimination (4) Foreign workers must be safe at work. Employers must comply with labor laws of the Occupational Safety, Health and Environment Act (5) Foreign workers must be treated the same with Thai workers (6) Foreign workers must receive social protection as social security under labor law. 2. The condition of the effectiveness of labor protection in the enterprise of migrant workers employment. What has some condition to do and that every condition how to result in the effectiveness of labor protection, found that (1) Inspecting from private sector say that in the partial of inspecting from private sector of the organization enforcement such as policeman, in order to migrant workers can receive the safety and security. (2) Following the law of enterprise performent say that in the partial of Inspecting from private sector the problems and obstacles of the protection of foreign workers in the Labour Protection Act B.E. 2541 (A.D. 1998) consisting of the story of law enforcement concerned Ministry of Labour has so much the labour law, procedure of employer for saving the cost, the employer try to do, and attempt every way and procedure of labour inspecter enforcement unclearly,has the less efficiency inspector. (3) Knowlegement and Perceving the data and information of migrant workers say that. the knowlegement of some nationally of migrant workers such as Myanmar has known the basic of labour privilege quite well.
